Internet Policy

Springnet1's internet services includes the availability of e-mail, web browsing, file transfer protocol (FTP), telnet and gopher services. For the enjoyment of the Springnet1's subscribers, Springnet1 does not limit access to the Internet. 

Each Springnet1 subscriber is responsible for his/her activities on the internet and agrees to hold Springnet1 harmless. Springnet1 subscribers accept full responsibility for the activities of any person(s), including persons of minority age, accessing the internet using the subscriber's Springnet1 account. Springnet1 reserves the right to terminate any subscriber's account, if in the opinion of Springnet1, the internet activities of the subscriber subject other Springnet1 subscribers to a limitation of service, including but not limited to a degradation of system performance or less than full accessibility to the internet. 

Each Springnet1 Subscriber expressly agrees that use of the service, Springent1's e-mail services and the internet, are at the Subscriber's sole risk.  The service and  Springnet1's e-mail services are provided on an "as is," "as available" basis without warranties of any kind, either expressed or implied, unless such warranties are legally incapable of exclusion.  Springnet1 makes no warranties of any kind with respect to its E-Mail service and is not responsible for any message which may not be delivered or received as intended by the sender or the expected recipient.  Telephone charges are the responsibility of the Springnet1 Subscriber.  Each Springnet1 Subscriber is responsible for knowing what phone number his or her computer is dialing and what charges the Springnet1 Subscriber's local and/or long distance telephone company will assess to dial one of Springnet1's modem lines.  Springnet1 has no responsibility to reimburse an Springnet1 Subscriber for any telephone charges. 

Springnet1's entire liability and a subscriber's exclusive remedy with respect to use of the service is limited solely to the amount paid by the Springnet1 Subscriber for access and use the service. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states the provider's liability is limited to the extent permitted by applicable state law. 

In consideration of the services provided by Springnet1, each Springnet1 subscriber irrevocably agrees that, subject to Springnet1's sole and absolute discretion, all suits, actions or other proceedings in any way, manner or respect arising out of or from or related to the Service shall be subject to litigation in court having situs in Springfield, Illinois; and Springnet1 subscriber hereby waives trial by jury and consent and submits to the jurisdiction of any local, state, or Federal court located in Sangamon County, Illinois, and hereby waives any rights such Springnet1 subscriber may have to transfer or change the venue of any suit, action or proceeding arising in connection with the Service.
